Registers of interests - release of new approved forms

Purpose

This bulletin is to advise councils of the release of new approved forms relating to registers of interests.

Background

Registers of interests provide for transparency in local government decision making by disclosing details on a wide range of financial and non-financial interests of councillors, chief executive officers, senior employees of councils and persons closely related to these persons.

The requirements relating to registers of interests are set out under the Local Government Act 2009 (LGA), Local Government Regulation 2012, City of Brisbane Act 2010 (CoBA) and the City of Brisbane Regulation 2012 (CoBR) and specific information must be submitted by relevant persons in the approved form to the council's chief executive officer or mayor as required.

Approval of new register of interest forms – Version No: January 2014

New register of interest forms were approved by the Chief Executive of the Department of Local Government, Community Recovery and Resilience on 22 January 2014. Notification of these forms has also been published in the Government Gazette on 24 January 2014.

The new forms reflect changes resulting from the recent implementation of legislative amendments included in the Local Government and Other Legislation Amendment Act 2013 and the Local Government Legislation Amendment Regulation (No. 4) 2013.

In line with these legislative amendments, the forms reflect the:

  • change in terminology relating to senior contract employees under the CoBA and CoBR;
  • inclusion of councillor related register of interest provisions under the LGA and CoBA; and
  • additional penalty provision applying to councillors that are found to have intentionally failed to complete or update their register of interest.

Additional changes have also been made to the general notes section to provide further clarification to councillors in relation to the declaration of election donations.

Sample forms have also been prepared to provide guidance to those required to complete these forms.
