Electronic access to rating category statement

Purpose

The purpose of this bulletin is to inform local governments of legislative amendments that will allow them to give a rating category statement to a ratepayer who has consented to receive their rates notices electronically:

  • with the rates notice
  • by including the rating category statement in the rates notice
  • by giving the person electronic access to the rating category statement.

Background

Currently, section 100 of the City of Brisbane Regulation 2012 (CBR) and section 108 of the Local Government Regulation 2012 (LGR) provide that a rates notice, including a rating category statement contained in or accompanying the notice, may be given electronically to a person if the person has given consent to the notice being received electronically.

Currently, a rating category statement may only be given electronically to the ratepayer by the following methods:

  • with the rates notice
  • by including the rating category statement in the rates notice.

Details

The Local Government Legislation Amendment Regulation (No. 1) 2017 (SL No. 65 of 2017) was made by the Governor in Council on 4 May 2017 and notified on the Queensland legislation website on 5 May 2017. It amends the CBR and the LGR to provide that, if a rates notice is given to a person electronically, a rating category statement may be given electronically to the person:

  • with the rates notice
  • by including the rating category statement in the rates notice
  • by giving the person electronic access to the rating category statement (e.g. providing the person a message stating that the statement is available to read by opening a stated hyperlink).

The amendments only apply to a ratepayer who has given consent to the rates notice being received electronically. A ratepayer who has not given consent will not be affected by the changes and will continue to receive their rates notice and rating category statement in paper form.
