Introduction of new Act and relevance to development schemes

On 1 February 2013 the Urban Land Development Authority Act 2007 (ULDA Act) was repealed and replaced with the Economic Development Act 2012 (ED Act). Existing Urban Development Areas (UDAs) still exist and have been transitioned under the ED Act to become Transitioned UDAs or Priority Development Areas (PDA).

Development schemes are still valid for UDAs previously declared under the repealed ULDA Act and the land use and development requirements still apply. No changes have been made to them as a result of the ULDA Act being repealed.

Adoption of the development scheme

On 26 April 2013 the Toolooa Priority Development Area (PDA) Development Scheme was approved by the state government.

Public notification for the Toolooa PDA Proposed Development Scheme was undertaken under the ULDA Act between 29 June and 13 August 2012.

During the publication notification period all interested parties including the community, residents, local business operators, state agencies and Gladstone Regional Council were invited to view the proposed development scheme and make a written submission.

All the submissions received were considered and the proposed development scheme was amended in response to issues as considered appropriate. A submissions report (EDQ Submissions Report) was prepared which summarised the submissions received, the merits of those submissions and the extent to which the proposed development scheme was amended to reflect the submissions.

On 11 February 2013 the EDQ Submissions Reports and development schemes were submitted to the Minister for Economic Development Queensland (MEDQ) for his consideration.

At this time, people who made a submission during the public notification period (submitters) were notified that the MEDQ was considering approving the development schemes. If those submitters were affected owners and they were not satisfied with how their concerns had been addressed after the initial public notification period, they had a further opportunity to write to the MEDQ to request he amend the development schemes be amended to protect their interests.

The MEDQ had until 16 April 2013 to consider any further submissions received from affected owners and consider adopting the development schemes. The MEDQ has prepared a second Submissions Report (MEDQ Submissions Report) summarising the submissions made to him, the merits of the submissions and the extent to which the proposed development scheme was amended to reflect submissions.

On 26 April 2013 the Toolooa PDA Development Scheme was approved by the state government.

The development scheme is the planning document that will assist in planning, carrying out, promoting, coordinating and controlling the development of land in the Toolooa PDA. The development scheme supersedes the Interim Land Use Plan which no longer has effect now that the development scheme has been adopted.

All development applications within the transitioned PDA will now be assessed against the development scheme.
