How to make an application under Right to Information or Information Privacy

While we proactively release much information to the community about our activities, the Right to Information Act 2009 (RTI Act) provides a formal means of requesting access to general information held by the department that is not normally publicly available.

Where we are unable to release your personal information administratively, or where you are seeking to amend your personal information because you consider it to be incorrect, misleading or out of date, the Information Privacy Act 2009 (IP Act) provides a formal means of requesting access to, and amendment of your personal information.

A formal application for access to government-held information under Right to Information or Information Privacy should only be made as a last resort, where information is not otherwise accessible.

Fees and charges

Right to Information applications must be accompanied by the application fee to the department, as required under section 24 of the RTI Act.

From 1 July 2015, the Right to Information application fee is $44.80. Cheque or money-order must be made payable to the department.

In addition to the application fee, you may be charged for following:

  • processing documents if your application takes longer than five hours to process ($6.95 for each 15 minutes or part thereof)
  • access to documents (black-and-white photocopy of the document in A4 size - $0.25 for each page).

Please note that all processing and access charges are normally payable when we notify you of the decision regarding your application.

There are no charges for applications under Information Privacy but you will need to provide evidence of your identity (e.g. a certified copy of your driver licence).

How long will it take to process my application?

A formal application is generally processed within 25 business days (5 weeks), but this can be extended in some circumstances.
